SALES AGREEMENT


In consideration of the purchase price or other good and valuable consideration, the receipt of which is now acknowledged by the owner/breeder, hereinafter know as the Seller, all right, title and interest of the Seller to the dog described below is transferred to the undersigned Buyer subject to the terms and conditions following.

BREED: <West Highland Whiter Terrier or Norwich Terrier>. SEX:<male or female> WHELPED <birthdate>; AKC LITTER/REGISTRATION <number>; SIRE: <name of dad>; DAME: <name of mom>

" The Seller certifies said dog is in good health, is free of known congenital defects, and has had inoculations appropriate to the age. The buyer will be given a complete record of all inoculations and worming done before the sale.
" Said dog is to be taken to a veterinarian of the Buyer's choice and at the Buyer's expense within 3 days of delivery by Seller to Buyer for a health check. A signed statement from the veterinarian stating the condition of health must be sent to the Seller within seven days of the exam. AKC registration paper will be sent to the Buyer upon receipt of the veterinary statement. Failure to do so will relieve Seller from all liability.
" If the dog is found ill upon the first examination, the Seller must be notified within 24 hours of the exam. The dog should be returned to the Seller at Buyer's expense within 48 hours of the exam. The Seller will refund the total purchase price.
" This contract does not cover the dog's breeding potential or ability, or show potential, nor does it cover death or illness due to environmental circumstances or neglect.
" AKC registration forms shall be sent to the Buyer after all terms of this contract have been met.
" There are no other warranties expressed or implied, except as herein stated.
" The Seller has done all in her power to produce puppies free of inherited defects of the breed (In WESTIES: copper toxicosis, craniomandibular osteoporosis, Von Willebrand's Disease, hypothyroidism). Should an inherited disease occur within the first three years of life, the purchase price of the dog will be fully refunded. Determination of what constitutes a hereditary defect is to be by the unanimous agreement of two veterinarians agreeable to both parties. One of these veterinarians is to be a tenured faculty member of an accredited university veterinary teaching hospital or Board-certified in the applicable specialty. Cost of the opinions is to be assumed by the Buyer.
" The Buyer agrees to provide this dog with a fenced yard and/or will not permit this WESTIE to run loose outside its owner's yard. This Westie is to be considered a companion and thus, a "house" dog, that will not be left out in the weather. The Buyer shall never abandon this WESTIE to an animal shelter or sell it to a research center. If at anytime, the Buyer is no longer able to care for the dog, the Buyer shall first notify the Seller before the Buyer takes any action. The Buyer warrants the dog will not be sold or given to any other person, family, organization or institution without prior written approval of the Seller.
" Help and assistance based on the Seller's 30+ years of experience in breeding, grooming, training and showing purebred dogs will be available to the Buyer when it is feasible for both parties.
" Show and/or breeding agreement addendum will be attached if necessary.
The Buyer swears he/she is not acting as an agent in the purchase of this WESTIE and that he/she will not sell this dog to any agent, pet store or research facility.

It is understood and agreed that the Buyer by signing this form has read and understands the provisions of this contract. Furthermore, this written agreement constitutes all conditions of the sale and no verbal statements either before or after the sale will be binding in any way.
